Il est nécessaire de distinguer les litiges relevant de la consommation qui opposent un consommateur à un professionnel et les litiges opposants plusieurs professionnels ou des particuliers entre eux.

Mais qu’est-ce qu’un consommateur ?

La loi n°2014-344 du 17 mars 2014, dite « Loi Hamon », reprise dans l’article préliminaire du Code de la consommation donne une définition :

“Au sens du présent code, est considérée comme un consommateur toute personne physique qui agit à des fins qui n’entrent pas dans le cadre de son activité commerciale, artisanale, industrielle, libérale ou agricole.”

Le consommateur est une personne physique qui, ayant acheté un bien ou un service, agit exclusivement pour lui-même.

En matière immobilière peut ainsi être considéré, par exemple, comme consommateur :

  • Un particulier client d’une agence immobilière mandatée pour l’acquisition ou la location d’un bien.

  • Un particulier propriétaire en conflit avec son administrateur de bien,

  • Un particulier locataire ou propriétaire en conflit avec une entreprise chargée de la rénovation du bien immobilier.

Ne relèvent pas, par exemple, de la médiation de la consommation :

  • Un litige entre un locataire et un propriétaire,

  • Un litige de voisinage,

  • Un litige entre un copropriétaire et le syndicat de la copropriété.

    Avant de saisir le médiateur de la consommation, le consommateur doit déjà̀ avoir tenté́ de résoudre son litige directement auprès du professionnel par une réclamation écrite ou avoir fait une réclamation selon les termes du contrat conclu avec le professionnel. La médiation de la consommation est un règlement extrajudiciaire des litiges de la consommation.

Si les conditions sont réunies, une médiation de la consommation se déroulera selon un processus précis et selon les textes en vigueur.

La procédure est gratuite pour le consommateur (R612-1 du Code de la Consommation).
